1. Acceptance of these Terms
These Terms of Use govern your access to and use of Dwellu, including the Dwellu mobile application, related services, content, features, and any future web or online services we provide.
By creating an account, accessing, or using Dwellu, you agree to these Terms. If you do not agree, you must not use Dwellu.
2. What Dwellu does
Dwellu is a consumer planning app for people collecting, organising, discussing, and refining home inspiration. It helps users save ideas, images, links, notes, documents, and related content into projects and spaces, collaborate with invited users, shortlist options, and record decisions.
Dwellu may also provide AI-assisted summaries, prompts, and insights based on information you add to the app. These features are intended to help you better understand your own preferences and planning direction.
3. What Dwellu does not do
Dwellu is a planning and inspiration organisation tool. It is not a builder, architect, engineer, surveyor, certifier, lawyer, financial adviser, interior designer, quantity surveyor, construction professional, or professional design service.
Dwellu does not provide:
- building, engineering, structural, compliance, certification, approval, or regulatory advice;
- guaranteed design, construction, feasibility, suitability, availability, or pricing advice;
- professional project management or construction management services;
- confirmation that any idea, design, image, product, material, finish, supplier, or vendor is suitable, lawful, available, safe, affordable, compliant, or buildable.
You are responsible for obtaining professional advice before relying on any information, decision brief, AI output, saved idea, or design direction for a real project.
4. Accounts and eligibility
You must be at least 18 years old to create an account or use Dwellu.
You are responsible for keeping your login details secure and for all activity that occurs under your account. You must notify us promptly if you suspect unauthorised access to your account.
We may suspend or terminate your account if we reasonably believe you have breached these Terms, misused the app, infringed another person’s rights, or created legal, security, or operational risk.
5. User content
You may upload, save, create, or share content in Dwellu, including images, screenshots, links, notes, documents, comments, reactions, project information, space names, preferences, and decision records.
You retain ownership of your content. By adding content to Dwellu, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display, transmit, analyse, and use that content solely for the purpose of operating, securing, improving, and providing Dwellu and related services.
You represent that you have the right to upload and use the content you add to Dwellu.
You must not upload content that:
- infringes copyright, trade marks, privacy, confidentiality, or other rights;
- is unlawful, misleading, offensive, abusive, discriminatory, obscene, or harmful;
- contains malware, spyware, or malicious code;
- contains another person’s personal information without authority;
- is used to harass, monitor, or harm another person.
6. Third-party content and links
Dwellu may allow you to save links or references to content from third-party platforms, websites, vendors, social media services, inspiration sources, or product pages.
We do not control third-party content and are not responsible for its accuracy, availability, legality, suitability, pricing, delivery, performance, quality, or ongoing accessibility.
Saving a third-party link in Dwellu does not mean we endorse that content, product, vendor, service, or supplier.
7. Collaboration and sharing
Dwellu may allow you to invite a partner, family member, collaborator, or other person into a project.
You are responsible for deciding who you invite and what content you share with them. Invited users may be able to view, comment on, react to, or otherwise interact with project content depending on the features available at the time.
You must not invite someone to a project or share content with them unless you have authority to do so.
8. AI-assisted features
Dwellu may use artificial intelligence to analyse user-provided information and generate summaries, design direction, preference insights, guided prompts, or decision-support content.
AI outputs are generated from available user data and may be incomplete, inaccurate, outdated, or unsuitable for your circumstances. AI outputs are provided for general planning assistance only.
Dwellu AI reflects and summarises user-provided content. It does not verify whether an idea is buildable, compliant, affordable, available, structurally suitable, professionally recommended, or fit for your specific project.
You must not rely on AI outputs as professional advice. Before making real-world decisions about design, building, renovation, purchasing, budgeting, compliance, safety, materials, or construction, you must verify the information with appropriate professionals.
We may process your uploaded content, notes, links, comments, preferences, and related project information to provide AI-assisted features. Further details are set out in our Privacy Policy.
9. Early access, testing, and evolving features
Dwellu may release features in early access, soft launch, testing, or limited availability. Some features may be experimental, incomplete, changed, paused, removed, or unavailable.
During beta, early access, soft launch, or testing periods:
- features may contain bugs or errors;
- data may not always display as expected;
- performance may vary;
- certain AI, collaboration, export, notification, storage, account, payment, or subscription features may change;
- we may request feedback to improve the app.
You should not use Dwellu as the only record of critical information for a real building or renovation project.
10. Subscriptions, payments, and commercial features
Dwellu may be used free of charge within applicable free-tier and fair-use limits. Dwellu also offers, or may offer, optional paid features through the Apple App Store and Google Play, including:
- a recurring Subscription, which may provide account-level access, higher limits, or additional features;
- a Project Pass, which may unlock a single project or project type for a stated period;
- a Collaborator Add-on, which may increase collaborator capacity or related collaboration access.
The products, prices, inclusions, billing period, renewal terms, and cancellation terms shown in the app at the time of purchase apply. We may change free limits, paid offerings, pricing, or inclusions from time to time. Where a change affects an existing paid entitlement, we will follow applicable store rules and take reasonable steps to notify you where required.
Purchases and billing
In-app purchases are processed by Apple or Google through their billing systems and our billing partner, currently RevenueCat. We do not receive or store your full payment card details. We may receive limited purchase and entitlement information, such as the product purchased, subscription or entitlement status, renewal or expiry date, cancellation state, transaction identifiers, and related app-user identifiers needed to unlock features, restore purchases, reconcile purchases, and prevent fraud.
Refunds, chargebacks, and billing disputes for store purchases are handled under Apple’s or Google’s rules. Contact the relevant store first for purchase refunds.
Auto-renewal
Recurring subscriptions, including any account Subscription or Collaborator Add-on, renew automatically until cancelled. Renewal terms will be shown in the purchase sheet before you buy.
Cancellation is your responsibility
Cancelling or managing any paid subscription is your responsibility, including:
- the monthly Subscription;
- any Collaborator Add-on; and
- any other auto-renewing product we offer through the stores.
You must cancel through your Apple ID / App Store or Google Play subscription settings, or through any “Manage subscription” path we provide in the app that opens the store’s subscription management screen.
Deleting your Dwellu account, leaving a project, locking a project, removing a collaborator, deleting a project, or uninstalling the app does not cancel store subscriptions. Unused Collaborator Add-ons or other recurring paid products may continue to bill until you cancel them through the relevant store.
One-time Project Pass purchases are generally not recurring. Store-specific refund, restoration, and entitlement rules still apply.
Restoring purchases
You may restore eligible purchases on a device signed into the same Apple or Google account, subject to store rules and product terms. A Project Pass is typically linked to one project and may not be transferable to another project unless the app states otherwise.
Ads, referrals, and partners
We may later introduce sponsored placements, referral links, partner offers, vendor offers, or advertising. Where required, we will identify commercial placements. Those features are separate from the paid unlocks described above.
11. Fair use and usage limits
Free access to Dwellu is provided on a fair-use basis for normal household planning. To keep the service reliable and sustainable, we apply soft limits and gates that may include limits on items, spaces, projects, collaborators, storage, AI use, share capture, exports, or other features.
Limits may depend on your plan, project type, project entitlements, and our current free-tier settings. We may change limits over time. When you reach a limit, you may be asked to upgrade, wait for a reset period where applicable, or stop that action.
You must not attempt to circumvent limits or abuse free access, including by creating accounts or projects solely to evade quotas, automating bulk creation of content, repeatedly creating duplicate spaces or projects to avoid limits, or otherwise gaming the free tier.
We may suspend, restrict, or terminate access where we reasonably believe fair use has been abused, entitlements have been misused, or the service is at risk.
Paid features unlock higher capacity only for the products, users, or projects they cover. Buying a Project Pass or Collaborator Add-on does not remove all limits everywhere in Dwellu unless the relevant product description says so.
12. Acceptable use
You must not:
- misuse, disrupt, reverse engineer, scrape, copy, or interfere with Dwellu;
- attempt to gain unauthorised access to any system, account, database, or network;
- use Dwellu for unlawful, fraudulent, harmful, or abusive purposes;
- upload malicious code or attempt to compromise app security;
- use automated tools to overload or extract data from Dwellu;
- attempt to circumvent usage limits, entitlements, subscriptions, payment gates, or fair-use controls;
- impersonate another person or misrepresent your identity;
- use Dwellu to provide professional advice unless you are appropriately qualified and authorised.
13. Intellectual property
Dwellu, including its name, branding, design, software, interface, workflows, databases, features, text, icons, and other materials, is owned by us or licensed to us.
You must not copy, reproduce, modify, distribute, sell, or exploit any part of Dwellu except as permitted by these Terms or applicable law.
Nothing in these Terms transfers ownership of Dwellu or our intellectual property to you.
14. Availability and changes
We may update, modify, suspend, or discontinue Dwellu or any feature at any time.
We do not guarantee that Dwellu will always be available, uninterrupted, secure, error-free, or compatible with every device or operating system.
15. Data backup
Although we take reasonable steps to protect data, you are responsible for keeping your own copies of important information, files, images, documents, and decisions.
Dwellu should not be treated as the only storage location for critical project, legal, financial, design, construction, or compliance records.
16. Privacy
Our collection, use, storage, sharing, and protection of personal information is described in our Privacy Policy. By using Dwellu, you agree that we may handle your information in accordance with that Privacy Policy.
17. Disclaimers
To the maximum extent permitted by law, Dwellu is provided on an “as is” and “as available” basis.
We do not warrant that:
- Dwellu will meet your requirements;
- any inspiration, decision brief, AI output, or saved content will be accurate or suitable;
- any product, design, finish, material, vendor, builder, professional, or referral will be suitable or available;
- your project can be built, approved, financed, priced, or completed based on information in Dwellu.
18. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, consequential, special, incidental, exemplary, or punitive loss, including loss of profits, loss of opportunity, loss of data, project delay, design error, construction issue, budget overrun, payment dispute, unused paid entitlement, or reliance on AI-generated content.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by applicable law, including resupply of the service or payment of the cost of resupply where legally permitted.
Nothing in these Terms excludes rights that cannot lawfully be excluded, including rights under applicable consumer protection laws.
19. Indemnity
You agree to indemnify us against claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Dwellu, breach of these Terms, infringement of third-party rights, or unlawful content uploaded by you.
20. Termination
You may stop using Dwellu at any time. You may also request account deletion in accordance with our Privacy Policy and in-app account deletion process.
We may suspend or terminate your access where reasonably necessary to protect users, comply with law, manage security risk, enforce these Terms, prevent misuse of entitlements, or protect the service.
21. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the app or by email.
Your continued use of Dwellu after changes become effective means you accept the updated Terms.
22. Apple App Store users
If you download, access, or use Dwellu through the Apple App Store, Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), available at:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
is incorporated into these Terms by reference and applies to your licence and use of the Dwellu iOS application.
These Terms also govern your Dwellu account, subscriptions, purchases, Project Passes, Collaborator Add-ons, collaboration features, user content, hosted services, AI-assisted features, and your relationship with Nexa Enterprise Solutions Pty Ltd.
If these Terms conflict with the Apple Standard EULA in relation to the licence or permitted use of the Dwellu iOS application, the Apple Standard EULA applies to the extent of that conflict. For all other matters concerning Dwellu, these Terms continue to apply.
Nexa Enterprise Solutions Pty Ltd, not Apple, is responsible for providing support for Dwellu, except for Apple App Store billing, transaction, refund, and subscription-management matters handled by Apple under Apple’s own rules and applicable law.
Purchases made through the Apple App Store remain subject to Apple’s billing, cancellation, refund, and subscription-management rules.
23. Governing law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
